With the elimination of the right to first contract arbitration following the coming into force of Bill 7, unions will likely make increased use of s. 43 of the Labour Relations Act, which permits applications for first contract arbitration. This paper examines the criteria used by the Ontario Labour Relations Board in determining whether to grant applications for first contract arbitration, and considers the principles guiding arbitrators in interest arbitration.
